Welcome to BingBong Services Inc. ("BingBong Services"). By choosing our services, you're entrusting us with maintaining your home or business with care and professionalism. These Terms of Service ("Terms") govern the use of our services, including but not limited to cleaning services, customer support, online platforms, and any third-party service providers we utilize. By using our services, you agree to these Terms, so please review them carefully before proceeding.

1. Authority and Acceptance

By using our Services, you affirm and agree that:

• You are legally capable of entering into a binding contract with BingBong Services;
• You will comply with these Terms and with all applicable laws, regulations, and rules at the local, state, and federal levels;
• You understand that BingBong Services operates under the protections of applicable trademark, copyright, and other intellectual property laws.
• If you are using the Services on behalf of an organization or legal entity, you confirm that you are authorized to agree to these Terms on behalf of such organization or entity.

2. Modifications to Services

BingBong Services reserves the right to modify, discontinue, or alter any aspect of our Services at any time. Changes that affect scheduled services will be communicated to you in advance. Your continued use of the Services after such modifications will constitute your acceptance of the changes. If you disagree with any changes, you must discontinue the use of our Services immediately.

3. Customer Conduct

You agree to treat all BingBong Services employees, contractors, and representatives with respect and professionalism. We reserve the right to terminate any customer relationship in cases of abusive, threatening, or inappropriate behavior. No refunds or credits will be provided in such cases, and any outstanding payments will remain due.

4. The Services

A. General Scope of Services

BingBong Services agrees to provide cleaning and related services as outlined in our agreements. You agree to pay the rates as quoted unless otherwise mutually agreed upon in writing.

B. Cleaning Supplies and Equipment

We provide basic cleaning supplies necessary for standard services, including vacuums, mops, and general-purpose cleaning products. We do not supply specialty cleaning products such as wood, leather cleaners, stainless steel polish, or heavy-duty cleaners (e.g., bleach). If your cleaning requires specific products for sensitive materials or particular surfaces, you must provide them and notify us before the service begins. BingBong Services is not liable for dissatisfaction from the use of standard products when specialty items are not supplied.

5. Third-Party Providers

A. Payments

BingBong Services uses third-party payment processors to handle payment transactions. We do not store or have access to your credit card or other payment information. By using our Services, you agree to comply with the third-party payment processor's terms and conditions. Any payment-related disputes should be directed to the payment processor.

B. Bookings

Our booking system is managed through third-party software. By scheduling or managing bookings through our platform, you agree to the third-party booking provider's terms of service. While we strive to ensure the accuracy and reliability of this system, we are not liable for any technical issues or interruptions caused by the third-party service.

6.Complementary Deep Cleaning Offer and Subscription Discounts:

At BingBong Services, we appreciate our loyal customers. As a thank you for choosing us, we offer the following:

Complimentary Deep Cleaning: Enjoy a complimentary deep cleaning when you sign up for our Weekly or Biweekly cleaning service. This is a one-time offer available with your initial booking to ensure your home is spotless from the start.

Subscription Discounts:

• 15% Discount: Subscribe to our Weekly cleaning service and receive a 15% discount on each cleaning session.
• 10% Discount: Opt for our Biweekly service and get a 10% discount per cleaning.
• 5% Discount: For those choosing our Monthly cleaning service, you'll receive a 5% discount on each visit.

7. Cancellation and Service Termination Policy

1. Cancellation Policy

You may cancel or reschedule your appointment without any fees as long as it is done at least 24 hours before the scheduled service time. This allows us enough time to adjust schedules and avoid unnecessary disruptions.

However, cancellations or rescheduling requests made within 24 hours of your scheduled service will incur a $65 fee. This fee covers the time reserved for your appointment and compensates our team for last-minute changes that prevent us from filling the slot.

• If you cancel within 24 hours of the scheduled time, the $65 cancellation fee will automatically be applied.
• Rescheduling within 24 hours will also result in the same $65 fee, as it impacts our scheduling in the same manner as a cancellation.
• If your cancellation or rescheduling is more than 24 hours in advance, no fee will be charged.

Cancellation within the first 3 months of recurrent service: If you cancel your recurrent Weekly or Biweekly service within the first 3 months, a cancellation fee will apply. This fee is determined by the number of services completed and the commitment made.

2. Service Termination

BingBong Services reserves the right to terminate any service under the following conditions:

• Unsafe Conditions: If our team arrives and encounters unsafe, unsanitary, or hazardous conditions that were not communicated to us prior to the appointment, we reserve the right to terminate the service immediately without refund. Unsafe conditions include but are not limited to pest infestations, the presence of biohazard materials, or dangerous environments.
• Abusive Behavior: Any form of harassment, abusive behavior, or hostile environment directed toward our staff will result in immediate termination of the service. In such cases, no refund will be issued, and any cancellation or rescheduling fees will still apply.
• Failure to Provide Access: If you fail to provide access to the premises at the agreed-upon time (e.g., lockouts, no key provided), we will terminate the service, and the $65 fee will apply for time lost.
• Repeated Violations: Continuous violation of our terms, such as last-minute cancellations or inappropriate conduct, may lead to permanent termination of your account with BingBong Services. In such cases, any remaining balance owed for scheduled services must still be paid.

8. What We Don't Clean

BingBong Services provides comprehensive cleaning solutions, but there are some areas and tasks we do not cover to ensure the safety of both our staff and your property. These limitations are put in place to maintain quality, safety, and efficiency in our services.

• Height Restrictions: We do not clean areas that require reaching more than 6 feet above ground. Our team does not provide or use ladders, step stools, or other equipment to clean elevated surfaces.
• Heavy Lifting: Our cleaners are not permitted to move or lift heavy furniture, appliances, or large objects. Please ensure that all necessary areas are accessible for cleaning before our arrival.
• Biohazardous Materials: We do not clean or handle any biohazardous materials, including but not limited to:
• Human bodily fluids
• Animal waste
• Rodent droppings
• Sharp objects (e.g., needles)
• Hazardous chemicals

If such materials are present, we reserve the right to cancel the service immediately, and the $65 cancellation fee will apply.

• Post-Construction Cleaning: While we specialize in a range of cleaning services, post-construction or post-renovation cleaning is not included in our standards services. If your property has recently undergone construction or remodeling, please ensure that all dust, debris, and materials are removed before we arrive. If this is not specified beforehand, you may incur additional charges for adjustments prior to the start of your service.
• Pest Infestation: Our cleaners are not equipped to handle pest infestations, including but not limited to insects, rodents, or bed bugs. If an infestation is discovered during the cleaning process, we will stop work immediately, and the cancellation policy will apply.
• Fragile or Valuable Items: We are not responsible for cleaning delicate or high-value items such as:
• Fine china
• Antiques
• Electronics
• Artwork

Please secure or remove such items before the cleaning process. If they must be cleaned, please notify us in advance, and we may discuss any special handling requirements.

9. Damages and Liability

While our team is trained to perform their duties with care, you must notify us of any damages within 48 hours of service completion, providing photographs and damage estimates. We reserve the right to send our preferred professionals to assess or repair damages. Unauthorized repairs will void any claim for compensation.

Important Exclusions:

• Pre-existing damage: We are not liable for pre-existing damage, including but not limited to surfaces that are heavily worn or in disrepair.
• Specialty surfaces: We are not responsible for damages to materials like marble or hardwood floors if proper cleaning instructions or products were not provided.
• Personal items: We are not liable for damage to fragile or sentimental items not disclosed before the service.

10. Refunds and Credits

BingBong Services does not offer refunds. If you are dissatisfied with our service, you may request a complimentary re-cleaning as outlined in our Satisfaction Policy. Issuance of credits for future services is at our sole discretion and must be provided in writing.

11. Non-Solicitation of Employees

Any attempt to hire or solicit our cleaners for work outside of Bing Bong Services will result in a $25,000 fee. We reserve the right to pursue legal action to enforce this provision.

12. Termination of Agreement

BingBong Services reserves the right to terminate or suspend services at any time, for any reason, including violations of these Terms. You may terminate this agreement at any time by ceasing to use our Services and notifying us in writing. Any accrued rights, including payments and indemnity obligations, will survive the termination.

13. Indemnification

You agree to indemnify, defend, and hold harmless BingBong Services, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of our Services, your violation of these Terms, or any applicable laws.

14. Force Majeure

BingBong Services is not liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including natural disasters, governmental restrictions, wars, pandemics, or other unforeseen events.

15. Intellectual Property Rights

By submitting feedback or content through our platform, you grant BingBong Services a license to use and display that content. Ownership of the content remains yours, but we retain the right to use it without compensation.

16. Dispute Resolution and Legal Recourse

Any disputes arising from the use of our Services will be resolved through binding arbitration, except for small claims or intellectual property disputes. Arbitration will be conducted under the rules of the American Arbitration Association (AAA).

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

18. Limitation of Liability

To the maximum extent permitted by law, BingBong Services shall not be liable for any indirect, incidental, or consequential damages resulting from your use of our Services.

19. User Accounts

To use certain features of the BingBong Services platform, you may be required to create a user account. By creating an account, you agree to the following:

• Account Security: You are responsible for maintaining the confidentiality of your account login credentials, including your password. You agree to notify us immediately if you suspect any unauthorized use of your account.
• Accurate Information: You must provide accurate and complete information when creating your account. Providing false or misleading information may result in the suspension or termination of your account.
• One Account Per User: You may only create and use one account in your name. Creating multiple accounts for fraudulent purposes or to exploit offers may result in account suspension.
• Account Use: You agree to use your account solely for personal use. You may not transfer your account or allow others to use it. You are responsible for all activity that occurs under your account.
• Account Termination: BingBong Services reserves the right to terminate or suspend your account at any time, without notice, for any breach of these Terms, unauthorized use of your account, or at our sole discretion.

20. Acknowledgment of Terms

By accessing and using the BingBong Services platform, you confirm that you have read, understood, and agree to abide by these Terms of Service and the Privacy Policy. Your continued use of our Services constitutes acknowledgment and acceptance of these terms, including any future updates or modifications made in accordance with these Terms.
